Contractor shall –
Comply with the requirements on site safety monitoring under the Technical Memorandum for Supervision Plans and the Code of Practice for Site Supervision.
Integrate site safety into the overall management responsibilities.
Promote safety training for all levels of the parties involved.
Improve safety performance through procurement and contractual arrangement.
Pay for Safety Scheme (PFSS)
Principle of PFSS
In a competitive tendering environment, the assessment process leading to contract award should not unfairly result in a disadvantage to those tenderers who properly allow the cost of meeting their safety obligations, as compared with those who do not include an adequate allowance for safety in their tender price.
The intention is that each tenderer for a specific construction project will receive the same pre-priced safety items, and thus separating the safety and health provisions from competitive tendering.
Example of safety related items to be payable under PFSS
The Employer or any associated project participants should determine the suitability and implementation details when considering the adoption of the safety related items under PFSS, below are some example for reference only –
Provision and Updating of Safety Plan
Provision of Safety Officers
Provision of Safety Training and Workshop to Workers
Arrangement and Attendance of Site Safety Committee meetings
Arrangement and Attendance of Weekly Safety Walks
It is estimated that in a typical construction site the cost for such safety items would be between 0.5% and 2.0% of the total project sum.
Types of method of payment under different types of PFSS
Some PFSSs may include the use of a safety checklist to audit the safety performance of the Main Contractor and to certify payment to the Main Contractor on those audited items. (Mentioned by PNRC)
The payment claims of some of the PFSSs may be made monthly in respect of the items as the Works progress.
Some of the PFSSs may announce safety performance targets annually for participating Main Contractors and achievement of these targets will be awarded Milestone Payments.
Current Situation
Application of PFSS in public works projects has set a very good example about the significance of Employer’s commitment to site safety by paying safety related items through contractual conditions.
PNRC 78 encourages AP to recommend their clients to adopt the PFSS in construction contracts.
Also PNRC 78 suggest the contractors take the opportunity to initiate such provisions so as to flourish a fair and equitable environment for the contracting parties to handle site safety issues.
